Abstract

Penelitian ini dilakukan dengan melihat permasalahan yang terjadi antara taksi konvensional dan taksi online walaupun sudah diundangkannya Peraturan Menteri Perhubungan RI Nomor 118 Tahun 2018 Tentang Penyelenggaraan Angkutan Sewa Khusus sehingga penulis melakukan penelitian ini bertujuan untuk mengetahui efektivitas dan perlindungan hukum yang diberikan oleh Peraturan Menteri Perhubungan Nomor 118 Tahun 2018 Tentang Penyelenggaraan Angkutan Sewa Khusus pada taksi online maupun konsumen pengguna jasa angkutan sewa khusus di kota Batam. Penelitian ini menggunakan penelitian empiris dengan menggunakan data primer yang diperoleh dari hasil wawancara Dishub Batam, PT Gojek, PT Tanjung Berlian Indah, dan data sekunder untuk mendukung data primer. Teknik pengumpulan data dilakukan dengan teknik studi lapangan dengan observasi, dan wawancara. Setelah data terkumpul selanjutnya di analisis secara kualitatif dan kuantitatif. Peraturan Menteri Perhubungan Nomor 118 Tahun 2018 Tentang Penyelenggaraan Angkutan Sewa Khusus belum sepenuhnya efektif berjalan, yang saat ini berjalan efektif adalah fungsi pengawasan dalam hal izin-izin perusahaan perusahaan angkutan sewa khusus, sedangkan dalam hal izin penyelenggaraan, dan perlindungan hukum masih belum efektif, hal ini dikarenakan masih banyaknya armada taksi online yang sudah beroperasi sebelum aturan ini diundangkan, dan masih banyaknya permasalahan antara taksi konvensional dan taksi online yang sering terjadi, di lain sisi banyaknya masyarakat yang tidak mengetahui aturan yang baru diundangkan ini sehingga masyarakat masih belum mengetahui apa saja bentuk perlindungan hukum yang diberikan dari peraturan ini. ********************************************************************** The author conducts this research aims to determine the effectiveness of the Minister of Transportation Regulation No. 118 of 2018 concerning the Implementation of Special Rent Transportation in online taxis in the city of Batam, and to determine the relationship of the Minister of Transportation Regulation with Consumer Protection Law. In writing this thesis report, this research is a descriptive study, primary data obtained from interviews with Batam City Transportation Department employees, secondary data is secondary legal material that includes laws and regulations, books and other research results relating to the problem this. The data collection technique is done by interview technique. After the data is collected, it is analyzed qualitatively Based on the analysis that has been done, it can be concluded that Minister of Transportation Regulation Number 118 Year 2018 Concerning the Implementation of Special Lease Transportation is not yet fully effective, what is currently effective is only the supervisory function in terms of the licenses of special rental transport companies, whereas in the case of operating permits , quota, and legal protection are still not effective because of the large number of online taxi fleets that were in operation before the regulation was enacted, and the lack of supervision conducted by the Batam City Transportation Agency. On the other hand, many people do not know the newly enacted regulation due to the lack of socialization from government institutions.
