Abstract

Manusia pada umumnya memerlukan mahkluk lainnya. Hak manusia untuk hidup sejahtera, mendapatkan lingkungan yang baik dan sehat serta memperoleh pelayanan kesehatan dapat dinikmati oleh semua manusia. Namun adanya pengaruh realitas yang berupa finansial, teknologi dan fasilitas yang telah membatasi hak-hak manusia, tidak semua manusia memiliki kemampuan untuk memenuhi kebutuhannya, sehingga diperlukan adanya pertolongan sesama. Dalam sebuah negara, pemerintahlah yang berperan sebagai pertolongan terhadap rakyatnya melalui pembentukan sistem jaminan sosial yang berupa pelayanan kesehatan maupun ketenagakerjaan. Akan tetapi, suatu sistem jaminan sosial yang baik dan bermanfaat tidak mudah terbentuk. Dengan adanya organisasi internasional yang berpusat pada sistem jaminan sosial, negara yang sedang membentuk sistem jaminan sosial menjadi sangat terbantu. Maka dari itu, penulis melakukan penelitian ini untuk membandingkan sistem jaminan sosial antara Indonesia dengan Filipina dimana kedua negara memiliki sistem hukum yang kurang lebih sama. Dalam melakukan penelitian ini, penulis menggunakan metode normatif yang meninjau kembali hukum yang ada dengan implementasi dalam masyarakat. Dengan mempergunakan data sekunder, penulis melakukan pengumpulan data kepustakaaan dan literatur yang terdiri atas bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Kemudian, data yang telah dikumpulkan akan dianalisis secara kualitatif dan menghasilkan data deskriptif yang akan disajikan dalam laporan penelitian ini. Setelah penulis menganalisa melalui data yang diperoleh, penulis dapat membandingkan sistem jaminan sosial kedua negara berdasarkan hukum dan pedoman yang telah diakui oleh kedua negara. Hasil perbandingan yang dikaitkan dengan teori kemudian memberikan jawaban atas baik dan buruknya suatu sistem jaminan sosial. Dari hasil perbandingan ini pula didapatkan jawaban penelitian ini. Kemudian, penulis mengajukan saran dan perbaikan untuk meningkatkan sistem jaminan sosial yang dinilai masih kurang mencukupi. ********************************************************************** Humans are basically social creature. The right to live in prosperity, good and healthy environment as well as obtaining services should be basic for all humans. However, due to the financial reality, technology and other facilities limiting human rights, not all humans have the ability to meet their needs, therefore calling for help of others is essential. In a state, it is the government responsibility to provide assistance to its people through the establishment of social security system in a form of health and employment services. However, a good and useful social security system is not easy to develop. With the existence of international organizations centering on the social security system, the state who are forming social security system will be greatly helped. Therefore, the writer conducted this study to compare the social security system between Indonesia and the Philippines where the two countries have more or less the same legal system. In conducting this research, the writer used normative method revisiting existing laws with their implementation in society. Using secondary data, the writer also collected series of archived and literature data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Afterwards, the collected data were then analyzed qualitatively to produce descriptive data presented in this research report. After this study, the writer could compare the social security systems between two countries based on laws and guidelines that have been recognized by both countries. The results of comparison associated with theories provide answers to the good and bad of social security system. Also through this comparison research, the author suggested few inputs for the improvement of inadequate social security system.
