Abstract
Kerja Praktek ini bertujuan untuk mengatasi hubungan kerjasama antara Developer Property dan Agent Property diantaranya: Pertama, bagaimana pengaturan hubungan hukum yang terjadi antara Developer Property dan Agent Property. Kedua, apa saja kelemahan dan masalah yang terdapat dalam perjanjian antara Developer Property Perusahaan Property dan Agent Property. Ketiga, bagaimana penyelesaian masalah yang dilakukan Perusahaan Property sebagai perantara jika terjadi wanprestasi dalam pelaksanaan perjanjian dengan Agent Property. Metode penelitian yang dipergunakan dalam penyusunan skripsi ini adalah yuridis normatif dan yuridis empiris. Metode penelitian yuridis normatif dipergunakan dalam penelitian ini guna melakukan penelusuran terhadap norma-norma hukum yang terdapat dalam peraturan perundang-undangan atau bahan-bahan hukum lain mengenai pemasaran perdagangan properti, sedangkan metode penelitian yuridis empiris diperuntukkan mengetahui kenyataan hukum dalam Perusahaan Property mengenai pelaksanaan perjanjian keagenan. Luaran proyek yang dihasilkan berupa penyelesaian masalah yang dilakukan Perusahaan DeveloperProperty jika terjadi wanprestasi dalam pelaksanaan perjanjian keagenannya,dimana permasalahan tersebut timbul dari kelemahan-kelemahan perjanjian keagenan yang sudah diuraikan di atas, maka Perusahaan DeveloperProperty akan menyelesaikan terlebih dahulu di luar pengadilan dalam hal ini secara musyawarah demi kebaikan bersama. Tetapi tidak tertutup kemungkinan apabila penyelesaian masalah secara musyawarah gagal di lakukan, tentu penyelesaian sengketa akan berlanjut penyelesaiannya dalam jalur pengadilan. Pelaksanaan penyelesaian masalah secara musyawarah dalam perjanjian keagenan Perusahaan DeveloperProperty menjadi kewajiban bagi para pihak karena hal tersebut sudah dinyatakan dalam klausula perjanjian yang sudah disepakati dan ditandatangani para pihak yang bersangkutan. ********************************************************************** This Job Training aims to overcome the cooperative relationship between Property Developer and Property Agent including: First, how to regulate the legal relationship that occurs between Property Developer and Property Agent. Second, what are the weaknesses and problems contained in the agreement between the Property Developer Company Property and Property Agent. Third, how to resolve the problem that is done by the Property Company as an intermediary if there is a default in the implementation of the agreement with the Property Agent. The research methods used in the preparation of this thesis are normative juridical and empirical juridical. The normative juridical research method used in this research is to trace the legal norms contained in the legislation or other legal materials regarding the marketing of property trade, while the empirical juridical research method is intended to find out the legal reality in the Property Company regarding the implementation of agency agreements . The resulting project output is in the form of problem solving by the DeveloperProperty Company if there is a default in the implementation of its agency agreement, where the problem arises from the weaknesses of the agency agreement outlined above, then the DeveloperProperty Company will resolve it outside the court in this matter by deliberation for the common good. But it is also possible if the deliberate resolution of the problem fails to be done, of course the dispute resolution will continue to be resolved in the courts. Implementation of problem solving by deliberation in the DeveloperProperty Company agency agreement becomes an obligation for the parties because it has been stated in the agreement clause that has been agreed and signed by the parties concerned.
