Abstract
Handphone sebagai media komunikasi yang penting membutuhkan pulsa agar dapat berfungsi secara optimal. Karena kebutuhan tersebut, pelaku usaha mengambil peluang dan bersaing dengan mendirikan usaha di bidang telekomunikasi. Akan tetapi, ada beberapa bermasalahan yang terjadi diantaranya, yaitu pemotongan pulsa secara sepihak terhadap konsumen oleh operator jaringan selular dan permasalahan bagaimana perlindungan hukum yang diberikan kepada konsumen atas tindakan pemotongan pulsa sepihak tersebut berdasarkan Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen. Penelitian dilakukan dengan metode normatif (studi kepustakaan). Data-data yang sudah terkumpul dari bahan hukum primer, sekunder, dan tersier kemudian data tersebut diolah dan dilakukan analisis kemudian disusun dan diuraikan secara deskriptif dengan mengambil kesimpulan dari hasil analisis. Pemotongan pulsa sepihak terhadap konsumen dilakukan oleh pelaku usaha operator jaringan selular merupakan pelanggaran hukum berdasarkan Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen mengenai hak konsumen terkait hak atas kenyamanan, keamanan dan keselamatan serta untuk mendapatkan informasi yang benar, jujur, dan jelas atas jasa yang ditawarkan. Pelanggaran hukum oleh pelaku usaha juga termasuk melanggar kewajibannya untuk beritikad baik dalam melakukan kegiatan usahanya serta tidak memberikan informasi yang benar, jelas, dan jujur terhadap jasa yang dijual. Perlindungan hukum kepada konsumen berbentuk preventif dan represif. Preventif dinyatakan dengan UU Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, UU Nomor 36 Tahun 1999 Tentang Telekomunikasi dan dibentuknya Badan Regulasi Telekomunikasi Indonesia (BRTI) yang berwenang melakukan pengaturan dan pengawasan telekomunikasi di Indonesia. Represif, yaitu dibentuknya Badan Penyelesaian Sengketa Konsumen (BPSK) serta penyelesaian sengketa melalui Peradilan Umum. ********************************************************************** Mobile phone as an important communication media requires phone credit to function optimally. Because of these needs, business actors take the opportunity and compete by establishing businesses in the telecommunications sector. However, there are several problems that occur including, namely unilateral phone credit deduction to consumers by cellular operators and the problem of how the legal protection given to consumers for unilateral phone credit deduction based on Law No. 8/1999 On The Consumer Protection. The research was conducted with a normative method (library research). The data that has been collected from primary, secondary and tertiary legal materials are then processed and analyzed then arranged and described descriptively by drawing conclusions from the results of the analysis. The unilateral phone credit deduction for consumers by operators cellular is a violation of the law based on Law No. 8/1999 On The Consumer Protection concerning the rights of consumers related to the right to comfort, security and safety and to obtain true, honest and clear information on services which is offered. Violations of the law by business actors also include violating their obligations to have good faith in carrying out their business activities and not providing true, clear, and honest information about the services being sold. Legal protection for consumers in the form of preventive and repressive. Preventive is stated in Law No. 8/1999 On The Consumer Protection, Law No. 36/1999 On The Telecommunications and the establishment of the Indonesian Telecommunications Regulatory Agency (BRTI) which has the authority to conduct telecommunications regulation and supervision in Indonesia. Repressive, i.e. the formation of the Consumer Dispute Settlement Body (BPSK) as well as dispute resolution through the General Courts.
