Abstract

Pelaksanaan penelitian ini dilakukan dengan tujuan untuk mengetahui konsep penerapan diversi oleh pihak penyidik serta efektivitas penerapan diversi tersebut terhadap anak sebagai pelaku tindak pidana sesuai dengan peraturan Undang-undang Nomor 11 tahun 2012 tentang Sistem Peradilan Pidana Anak didalam wilayah hukum Polresta Barelang. Penelitian ini dilakukan oleh Peneliti dengan menggunakan metode penelitian hukum empiris sebab didalam penelitian ini Peneliti mengunakan data primer yang Peneliti peroleh dari pihak penyidik anak khususnya dalam Unit Perlindungan Perempuan dan Anak Polresta Barelang melalui wawancara serta pengumpulan data-data yang berkaitan dengan kasus tindak pidana anak yang terjadi di wilayah hukum Polresta Barelang yang kemudian Peneliti kaji dengan menggunakan teori efektivitas hukum yang dikemukakan oleh Ahli Hukum Soejano Soekanto atas penerapan diversi yang telah dilaksanakan diwilayah hukum Polresta Barelang serta Peneliti mengunakan data sekunder berupa literatur-literatur serta buku-buku ilmu hukum yang berkaitan dengan pokok permasalahan yang Peneliti teliti didalam Penelitian skripsi ini. Berdasarkan hasil penelitian yang telah Peneliti lakukan, dapat disimpulkan bahwa penerapan mekanisme diversi oleh Penyidik unit Pelayanan Perempuan dan Anak Polresta Barelang dalam tahap penyidikan telah efektif sebagaimana dikaji berdasarkan teori efektivitas hukum yang dikemukakan oleh Ahli Hukum Soejano Soekanto. ********************************************************************** The implementation of this research was carried out with the aim of knowing the concept of the application of diversion by the investigators and the effectiveness of applying the diversion to children as perpetrators of crimes in accordance with The Law Number 11 of 2012 Concerning The Juvenile Justice System in the Barelang Police Area. This research was conducted by the author using empirical legal research methods because in this study the authors used primary data that the author obtained from the child investigator, especially in the Barelang Police Unit through interviews and collecting data relating to cases of child crime that occurred in the region. Barelang law then the author reviews it using the theory of legal effectiveness proposed by legal expert Soejano Soekanto for the application of diversions that have been carried out within the Barelang police law area and the author uses secondary data in the form of several literature literature and legal books relating to the subject the problem that the author examined in writing this thesis. Based on the results of the research that the author has done, it can be concluded that the application of the diversion mechanism by the child investigators during the investigation phase is already effective as reviewed based on the theory of legal effectiveness proposed by legal expert Soejano Soekanto.
