Abstract

Keberadaan Sertipikat Hak Milik di Kota Batam dalam wilayah yang telah ditetapkan kepada BP Batam selaku pemegang Hak Pengelolaan Lahan beserta kewenangannya merupakan hal yang patut dipertanyakan atas eksistensinya secara yuridis. Penelitian tugas akhir ini bertujuan untuk mengetahui dan menjadikan bahan pengembangan wawasan secara yuridis atas Sertipikat Hak Milik yang telah terbit dalam wilayah hak pengelolaan lahan BP Batam. Prosedur atau cara yang diterapkan oleh peneliti yakni metode penelitian hukum normatif-empiris dengan menggunakan dengan cara studi pustaka, observasi dan wawancara. Penulis menghasilkan manfaat teoritis serta praktis pada penelitian ini yaitu memberikan sumbangan pemikiran terutama dalam menjawab serta menganalisa dan menjadi bahan guna penimbangan dalam mengevaluasi permasalahan yang ada secara yuridis, untuk diaplikasikan penggunaannya dalam menyelesaikan permasalahan yang ada. Dalam penelitian ini, adapun peneliti menyimpulkan bahwa penerbitan sertipikat hak milik di kota batam yang merupakan wilayah hak pengelolaan dilatar belakangi atas terjadinya kesalahan dalam penafsiran serta penerapan peraturan perundang-undangan oleh Otorita Batam pada saat itu. Hal tersebut membuat penerbitan sertipikat hak milik di kota batam tidak sesuai dengan status areal tanah kota batam yaitu Hak Pengelolaan dimana tidak memberi wewenang untuk penerbitan selain dari pada Hak Guna Bangunan dan Hak Pakai. Kata kunci: BP Batam, Penerbitan, Sertipikat, Hak Milik, Hak Pengelolaan, areal tanah, Kota Batam, Yuridis. ********************************************************************** The existence of a Certificate of Property in Batam City within the territory which has been assigned to BP Batam as the holder of Land Management Rights and its authority is a questionable matter for its existence in a juridical way. This thesis research aims to know and make the material development of a legal perspective on the Certificate of Property that has been published in the area of land management rights BP Batam. The procedure or method applied by the researcher is the method of normative-empirical law research by using by way of literature study, observation and interview. The author produces theoretical and practical benefits in this research that is to contribute thoughts, especially in answering and analyzing and becoming a material for weighing in evaluating the existing problems in juridical, to be applied its use in solving the existing problems. In this study, as for the researchers concluded that the issuance of certificate of property rights in batam city which is the area of management rights background against the occurrence of errors in the interpretation and application of legislation by the Batam Authority at that time. It makes the issuance of certificate of ownership in batam city is not in accordance with the status of urban land area of the city that is the Right Management which does not authorize the issuance other than the Right to Build and Use Rights.
