Abstract

Dalam sistem pembelian online pre order biasanya dilakukan melalui perjanjian antara pihak penjual dan pihak pembeli, tetapi seringkali pembuatan perjanjian yang didasari oleh asas kebebasan berkontrak tersebut tidak memperhatikan unsur-unsur yang harus ada dalam suatu perjanjian, yang salah satu unsurnya adalah unsur accidentalia. Oleh karena itu, penelitian ini bertujuan untuk mengetahui mengenai unsur accidentalia yang seharusnya diterapkan di dalam pembelian pre order yang didasari asas kebebasan berkontrak serta penerapan unsur accidentalia dalam pembelian pre order sebagai upaya memberikan perlindungan hukum dalam pembelian online pre order. Salah satu lembaga yang memberikan perlindungan hukum adalah Badan Penyelesaian Sengketa Konsumen Kota Batam. Keberadaan badan ini merupakan amanat dari undang-undang Nomor 8 tahun 1999 tentang perlindungan konsumen yang kemudian dipertegas oleh keputusan presiden Nomor 23 tahun 2006 tentang pembentukan BPSK Kota Batam. Badan penyelesaian sengketa konsumen kota Batam yang kelahirannya oleh pemerintah kota Batam telah dirintis sejak ditetapkannya undang-undang Nomor 8 tahun 1999. Namun demikian badan ini baru terbentuk dan dilantik pada Tahun 2006 oleh Wali Kota Batam. Dengan fungsi utama yaitu menangani dan menyelesaikan sengketa konsumen diluar pengadilan. Sejak kelahirannya, BPSK Kota Batam beranggotakan 9 (Sembilan) orang anngota, terdiri dari 3 (orang) dari unsure pemerintah, 3 (tiga) orang pelaku usaha, dan 3 (tiga) orang unsure konsumen serta dibantu oleh 5 orang sekretaruat dari unsur pemerintah. ********************************************************************** It is very helpful in shortening the time and energy that is issued to meet human needs, giving rise to a new engagement with the form of buying and selling online through the Internet. Therefore, this study attempts to know what the accidentalia element that should be applied in online purchasing pre order were based on freedom of contract principle and the implementation of accidentalia element in the online purchasing pre order is an attempt to give legal protection in online purchasing pre order. One of the institutions that provide legal protection is the Batam City Consumer Dispute Settlement Agency. The existence of this body is a mandate of Law No. 8 of 1999 concerning consumer protection which was later confirmed by the presidential decree Number 23 of 2006 concerning the establishment of the Batam City BPSK. The Batam city consumer dispute resolution body whose birth was by the Batam city government has been initiated since the enactment of Law Number 8 of 1999. However, this body was only formed and inaugurated in 2006 by the Mayor of Batam. With the main function of handling and resolving consumer disputes outside the court. Since its birth, BPSK Batam City consists of 9 (nine) members, consisting of 3 (people) from government elements, 3 (three) business people, and 3 (three) consumer elements and assisted by 5 people from he government.
