Abstract

Penelitian ini bertujuan untuk;(a) Mengetahui bagaimana Pengakuan Anak Luar Kawin Pasca Putusan Mahkamah Konstitusi Nomor 46/PUU-VII/2010 Tentang Anak Luar Kawin;(b) mengetahui bagaimana Dampak Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 Tentang Status Anak Luar Kawin. Pada Penelitian Hukum ini penulis menggunakan metode penelitian Hukum Normatif dimana dalam hal ini penulis membahas mengenai Putusan Mahkamah Konstitusi Nomor 46 /PUU-VIII/2010 Tentang Uji Materil Pasal 2 Ayat 2 dan Pasal 43 Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan yang melanggar Hak Konstitusi dalam Pasal 28 b Ayat 2 dan 3 Undang-Undang Dasar 1945 yang mengambil kasus daripada permohonan uji materil atas dasar status anak daripada penyanyi dangdut Machica Mochtar atas anaknya yang berada dalam status anak luar nikah atas pernikahaannya dengan (Alm) Moerdiono. Demikian hal ini sebagaimana Putusan Mahkamah Konstitusi tersebut sebaiknya memang harus segera di Undang-Undangkan untuk menimalisir diskriminasi dan pandangan sebelah mata oleh kalangan masyarkat terhadap anak luar kawin dan memberikan hak keperdataan yagn sama dengan anak sah lainnya yang secara defenisial mereka juga memiliki hak untuk hidup dan dianggap di dalam keluarga sehingga atas penelitian ini sebaiknya putusan tersebut dapat menjadi acuan untuk pasangan suami/isteri yang ingin anaknya mendapat status anak sah dan memiliki hak keperdataan sama seperti anak lainnya. ********************************************************************** This study aims to: (a) Know how the Recognition of Outer Children of Marriage Post-Decision of the Constitutional Court Number 46 / PUU-VII / 2010 concerning the Extraordinary Children (b) to know how the Impact of Constitutional Court Decision Number 46 / PUU-VIII / 2010 About Status Outer Child Marriage. In this Legal Research the author uses Normative Law research methods where in this case the author discusses the Decision of the Constitutional Court Number 46 / PUU-VIII / 2010 About Material Test Article 2 Paragraph 2 and Article 43 Law Number 1 Year 1974 About Marriage Intracting the Right The Constitution in Article 28 b Paragraphs 2 and 3 of the 1945 Constitution which takes the case rather than the petition for judicial review on the basis of the status of the child rather than the dangdut singer Machica Mochtar for his son in an illegitimate marriage status over his marriage to (Alm) Moerdiono. This is the same as the Constitutional Court Decision should be promptly enacted in the Laws to minimize discrimination and the eyesight of the public against the unmarried child and to grant the same civil rights to other legitimate children who defenitally also have the right to live and considered in the family so that the above research should be the decision can be a reference for couples who want their children to get the legal status of children and have the right civil rights just like any other child.
