Abstract

Peranan perlindungan Pekerja Migran Indonesia (PMI) dapat ditelusuri berdasarkan beberapa regulasi terkait, mulai dari tatanan ideal, konstitusional, instrumental dan implementasi. Perbaikan tata kelola migrasi yang mengutamakan peran pemerintah dibandingkan swasta sesuai amanat UU No 18 Tahun 2017, khususnya pada pasal 38 tentang pembentukan Layanan Terpadu Satu Atap (LTSA) yang bertujuan mewujudkan peranan penyelenggaraan pelayanan penempatan dan pelindungan PMI, memberikan efesiensi dan transparansi dalam pengurusan dokumen penempatan dan pelindungan PMI serta mempercepat peningkatan kualitas pelayanan PMI. Berdasarkan latar belakang di atas, masalah dalam penelitian ini meliputi: (1) Bagaimana peranan LTSA di Kota Batam sebagai lembaga penempatan dan pelindungan PMI melaksanakan Pasal 38 UU No. 18 Tahun 2017 tentang Pelindungan Kerja Migran Indonesia?; (2) Bagaimana Kendala LTSA di kota Batam sebagai lembaga penempatan dan pelindungan PMI dalam melaksanakan Pasal 38 UU No 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia?; (3) Bagaimana solusi kedepan meningkatkan peranan LTSA di Kota Batam sebagai lembaga penempatan dan pelindungan PMI dalam melaksanakan pasal 38 UU No. 18 Tahun 2017 tentang Pelindungan Kerja Migran Indonesia? Metode penelitian yang digunakan penelitian yuridis empiris guna melihat kenyataannya di lapangan. Diperkuat dengan metode yuridis normatif dengan cara mengkaji norma-norma yang terdapat dalam UU No. 18 Tahun 2017 Tentang Pelindungan Pekerja Migran Indonesia beserta aturan-aturan pelaksanaannya. Hasil penelitian menegaskan: (1) Peranan LTSA di Kota Batam sebagai lembaga penempatan dan pelindungan PMI melaksanakan Pasal 38 UU 18 Tahun 2017 tentang Pelindungan Kerja Migran Indonesia, belum optimal mewujudkan efektivitas penyelenggaraan pelayanan penempatan, memberikan efisiensi dan transparansi dalam pengurusan dokumen penempatan. Seluruh instansi terkait seyogianya dapat bekerja dan menggunakan sistem yang terintegrasi dalam proses verifikasi dokumen hingga penerbitan ijin yang dibutuhkan (Surat Keterangan Sehat, Surat Berkelakuan Baik, BPJS, Paspor dan EKTKLN; LTSA Batam belum optimal mewujudkan efektivitas penyelenggaraan pelayanan perlindungan, terbukti masih terjadi kasus keberangkatan ilegal di sejumlah pelabuhan tikus di Batam dan PMI Non Prosedural yang menjadi korban tenggelam di perairan Batam; (2) Kendala LTSA di kota Batam sebagai lembaga penempatan dan pelindungan PMI dalam melaksanakan Pasal 38 UU No 18 Tahun 2017 adalah kurangnya peranan pemerintah daerah dalam membuat regulasi sebagai payung hukum semua instansi terkait untuk pemberian pelayanan di LTSA, penyedian anggaran dari Angggaran Pendapatan Belanja Daerah (APBD), penyediaan sarana dan prasarana, serta penyediaan Balai Latihan Kerja (BLK) untuk meningkatkan ketrampilan PMI; (3) Solusi untuk meningkatkan peranan LTSA di Kota Batam dalam melaksanakan Pasal 38 UU 18 Tahun 2017 adalah mendorong pemerintah kota Batam dalam penerbitan regulasi dan meningkatkan koordinasi seluruh instansi terkait agar dapat bersinergi dan terintegrasi dalam mewujudkan efektivitas penyelenggaraan pelayanan penempatan dan perlindungan PMI. ********************************************************************** The role of protection of Indonesian Migrant Workers (IMW) can be traced based on several related regulations, starting from the ideal, constitutional, instrumental and implementation arrangements. Improvement of migration governance prioritize the role of the government compared to the private sector following the mandate of Law No. 18 of 2017, particularly in article 38 regarding the establishment of the One-Stop Integrated Service (LTSA) which aims to realize the role of providing IMW placement and protection services, providing efficiency and transparency in the management of placement documents and IMW protection and accelerate the improvement of IMW service quality. Based on the mentioned background, the problems in this study include: (1) How is the role of LTSA in Batam City as the placement and protection institution for IMW implementing Article 38 of Law No. 18 of 2017 concerning Protection of Indonesian Migrant Work ?; (2) What are the obstacles of LTSA in Batam city as an institution for IMW placement and protection in implementing Article 38 of Law No. 18 of 2017 concerning Protection of Indonesian Migrant Workers ?; (3) How does the future solution enhance the role of LTSA in Batam City as a placement and protection institution for IMW in implementing article 38 of Law no. 18 of 2017 concerning Protection of Indonesian Migrant Work? The research method used is empirical juridical research to observe the reality in the field strengthened by normative juridical methods by reviewing the norms contained in Law No. 18 of 2017 concerning the Protection of Indonesian Migrant Workers and the implementing regulations. The results of the study confirm: (1) The role of LTSA in Batam City as a IMW placement and protection agency implementing Article 38 of Law 18 of 2017 concerning the Protection of Indonesian Migrant Work, has not been optimal in realizing the effectiveness of the placement service, providing efficiency and transparency in the management of placement documents. All relevant agencies should be able to work and use an integrated system in the document verification process until the issuance of the required permits (Health Certificate, Good Behavior, BPJS, Passport and EKTKLN; LTSA Batam has not been optimal in realizing the effectiveness of providing protection services, as evidenced by the case of departure. illegal in several ports in Batam and non-prosedural IMW who are victims of drowning in Batam waters, (2) LTSA constraints in the city of Batam as an institution for placement and protection of IMW in implementing Article 38 of Law No. 18 of 2017 is the lack of the role of local governments in making regulations as legal auspices for all relevant agencies for providing services in LTSA, providing the budget from the Regional Expenditure Budget (APBD), providing facilities and infrastructure, and providing Work Training Centers (BLK) to improve IMW skills, (3) Solutions to enhance LTSA's role in Batam City is carried out by Article 38 of Law 18 of 2017 is to encourage the Batam city government in the issuance of regulations and improve coordination of all relevant agencies with the intention of they can work together and be integrated in realizing the effectiveness of the implementation of IMW placement and protection services.
