Abstract

Impor paralel adalah konsep yang digunakan untuk impor dan penjualan kembali produk asli dari distributor yang secara sah diperoleh dari produsen dengan harga yang lebih murah dan bukan membeli langsung dari produsen. Produk-produk ini ditempatkan di pasar di suatu negara dengan persetujuan dari pemilik HAKI dan mereka diimpor ke negara lain tanpa seizin pemilik HAKI. Impor paralel dibangun di atas prinsip exhaustion of rights atau habisnya hak kekayaan intelektual. Pada dasarnya ada tiga prinsip exhaustion of rights atas HAKI yang saling bersaing, yaitu; prinsip international exhaustion of rights, prinsip domestic/national exhaustion of rights dan prinsip regional exhaustion of rights. Berdasarkan perjanjian TRIPS masing-masing negara diberikan kebebasan dalam menentukan dan mengatur prinsip exhaustion of rights apa yang akan diaplikasikan. Permasalahan yang menjadi pembahasan ialah bagaimana pengaturan impor paralel dalam merek menurut hukum Indonesia, India serta New Zealand. Tujuannya ialah untuk mengetahui pengaturan impor paralel dalam merek menurut hukum Indonesia, India serta New Zealand. Serta hal apa yang dapat diadopsikan pada hukum Indonesia terkait impor paralel berdasarkan perbandingan tersebut. Penelitian ini, Penulis menggunakan metode penelitian normatif. Penelitian ini juga menggunakan perbandingan hukum sebagai bagian dari analisisnya, dengan teknik pengumpulan data melalui studi kepustakaan. Dan metode analisis data yang digunakan ialah metode kualitatif bersifat deskriptif. Hasil penelitian menunjukkan bahwa Indonesia sendiri belum ada pengaturan mengenai impor paralel. Sedangkan di India dan New Zealand telah ada peraturan terkait. Kemudian untuk upaya penyelesaian sengketa mengenai impor paralel di Indonesia ditempuh hukum perdata, di India dengan keputusan hakim sesuai dengan peraturan yang ada. Hal yang dapat diadopsi oleh Indonesia dalam hal ini ialah agar dapat mempertegas peraturan mengenai impor paralel dalam merek secara eksplisit. ********************************************************************** Parallel import is a concept used for importing and reselling original products from distributors that are legally obtained from producers at lower prices rather than buying directly from producers. These products are placed on the market in one country with the approval of the IPR owner and they are imported to another country without the permission of the owner. Parallel imports are built on the principle of exhaustion of rights or endless intellectual property rights. Basically, there are three competing principles of exhaustion of rights for intellectual property rights, namely; the principle of international exhaustion of rights, the principle of domestic/national exhaustion of rights and the principle of regional exhaustion of rights. Based on the TRIPS agreement, each country is given the freedom to determine and regulate the principle of exhaustion of rights to be applied. The issue under discussion is how the parallel import regulation in brands according to Indonesia, Indian, and New Zealand laws what can be adopted in Indonesia law regarding parallel imports based on these comparisons. In this study, the writer used a normative research method. This research also uses legal comparison as part of its analysis with data collection techniques through literature study. Data analysis method used is descriptive qualitative method. The results of the study showed that Indonesia has no regulation regarding parallel imports. While in India and New Zealand there are related regulations. Then to resolve disputes regarding parallel imports in Indonesia, civil law is adopted, in India with a judge& decision in accordance with existing regulations. What can be adopted by Indonesia in this case is to explicitly reinforce regulations regarding parallel imports in brands.
