Abstract

Konvensi Hak Anak merupakan salah satu pilar dari terjaminnya hak anak di dunia. Indonesia sebagai segara yang menganut sistem dualisme telah meratifikasi Konvensi Hak Anak pada tanggal 25 Agustus 1990 yang tercantum dalam Keputusan Presiden Nomor 36 tahun 1990 tentang Pengesahan Hak Konvensi Anak. Sebagai negara yang telah meratifikasi Konvensi Hak Anak, Indonesia harus mengakui hak anak sebagai bagian dari hak asasi manusia. Untuk mewujudkan hal ini, Indonesia memiliki Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak yang berlaku sebagai hukum nasional Indonesia. Adapun isi dari UUPA merupakan cerminan dari prinsip-prinsip Konvensi Hak Anak. Salah satu dari prinsip adalah untuk mendapatkan perlindungan. Perlu diketahui bahwa kekerasan seksual terhadap merupakan salah satu masalah internasional yang dihadapi banyak negara di dunia, termasuk Indonesia. Tingginya angka kekerasan seksual tiap tahun menimbulkan pertanyaan apakah implementasi Konvensi Hak Anak terhadap Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak telah diterapkan dengan baik atau malah sebaliknya. Maka dari itu, untuk meninjau lebih jauh permasalahan ini penulis akan menggunakan penelitian normatif dengan bantuan data sekunder dan Teknik pengumpulan data kepustakaan yang akan di analisa menggunakan metode kualitatif. ********************************************************************** The Convention on the Rights of the Child is one of the pillars of ensuring the rights of children in the world. Indonesia as a country that adheres to a dualism system has ratified the Convention on the Rights of the Child on 25 August 1990 which is stated in the Presidential Decree Number 39 of 190 concerning Ratification of the Convention on the Rights of the Child. As a state that has ratified the Convention on the Rights of the Child, Indonesia should recognize children's rights which are part of human rights. To realize this, Indonesia has national regulations that regulate child protection, namely Law Number 35 of 2014 concerning Child Protection. The contents of the Child Protection Act are a reflection of the principles of child rights that are found in the Convention on the Rights of the Child. One of them is about children's rights to get protection. Please note that Child Sexual Abuse is an international problem that is faced by many countries throughout the world, including Indonesia. The increasing number of sexual abuses each year raises questions about whether the implementation of the Convention on the Rights of the Child on Law Number 35 of 2014 concerning Child Protection has been applied well or vice versa. Therefore, to further examine this problem the author will conduct research using normative research using secondary data with the technique of collecting data in a library resource with qualitative methods.
