Abstract

Penelitian Tugas Akhir ini bertujuan untuk menganalisa dalam pelaksanaan penyelesaian perkara persaingan usaha tidak sehat dengan membandingkan persamaan dan perbedaan dalam dua negara yang berbeda yang mana ialah Indonesia merupakan negara berkembang dan negara Amerika Serikat ialah negara maju. Metodologi penelitian yang digunakan penulis ialah penelitian hukum normatif dengan menelaah teori-teori hukum serta perundang-undangan yang berlaku di kedua negara tersebut. Jenis data yang digunakan ialah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Pengumpulan data dilakukan dengan cara studi kepustakaan. Penelitian Hukum ini menggunakan pendekatan perbandingan hukum, dimana data dianalisis secara deskriptif kualitatif. Hasil penelitian yang penulis peroleh dari studi kepustakaan, maka terdapat beberapa perbedaan dan persamaan yang diuraikan penulis dalam penelitian ini sebagaimana sesuai dengan Teori Hukum Perbandingan yang dikemukakan oleh Michael Bogdan serta beberapa hal yang dapat diadaptasi di Indonesia terkait pelaksanaan penegakan hukum persaingan usaha lebih fleksibel dalam menerima saran-saran atau input-input dari badan-badan tanpa kehilangan sifat independennya dan dapat lebih efektif dalam rangka pelaksanaan penegakan hukum persaingan usaha. ********************************************************************** The task will be the end of this aims to analyze in the implementation of the settlement an unhealthy business competition by comparing the similarities and differences in two different countries which is Indonesia is developing world, and the United States of America is the developed countries. Research of this with the comparison of the rule of law, where data are analyzed a sort of descriptive set of qualitative. The results that writers get the study of literature, then there are some differences and the equations that described the author in this study as in accordance with the Theory of Justice The comparison is presented by Michael Bogdan as well as some of the things that can adapt in Indonesia regarding the conduct of law enforcement business competition more flexible in receiving suggestions or inputs in order of these agencies without losing the nature of the independent and can be more effective in the framework of the law enforcement business competition.
