Abstract

Tesis ini membahas tentang pentingnya ratifikasi Konvensi Perserikatan Bangsa-Bangsa (PBB) Mengenai Kontrak Jual Beli Barang Internasional oleh Negara Indonesia dalam pengembangan hukum kontrak dagang. Dalam perkembangan perdagangan internasional, terobosan dalam hukum Indonesia sangat diperlukan ketika berhubungan dengan pihak asing. Dalam hal ini penulis melihat bahwa Konvensi PBB Mengenai Kontrak Jual Beli Barang Internasional atau disebut dengan CISG mempunyai potensi dalam perkembangan hukum Indonesia terutama dalam hukum kontrak dagang. Negara mitra dagang utama Indonesia dan sejumlah Negara besar lainnya telah turut meratifikasi CISG. Tesis ini mengunakan penelitian hukum normative karena menitik beratkan pada penelitian kepustakaan yang intinya menggunakan metode deskriptif kualitatif. Selanjutnya, permasalahan yang dibahas dalam Tesis ini adalah mengapa Indonesia belum meratifikasi CISG dan apa yang menjadi dampak positif bagi Indonesia dari meratifikasi CISG serta apakah sudah saatnya bagi Indonesia untuk meratifikasi CISG. Kesimpulan melalui permasalahan yang dibahas, ditemukan bahwa sudah saatnya Indonesia meratifikasi CISG kedalam hukum kontrak perdagangan internasional di Indonesia. ********************************************************************** This thesis explains the importance of ratifying United Nations Convention on Contracts for the International Sale of Goods by Indonesian State in developing the law of trade contracts. With the advancing international trade, a legal breakthrough in Indonesia is required when it comes to making relation with foreign states. The writer sees that United Nations Convention on Contracts for the International Sale of Goods or abbreviated as CISG has potential in legal developments of Indonesia mainly in trade contract law. Trade partners of Indonesia and other major countries have ratified the CISG. The thesis used legal normative research due to its concentration on literature research with the point of using a descriptive qualitative method. The next issue in the thesis elaborates the reason why Indonesia has not ratified CISG and the positive impact for Indonesia for ratifying CISG, also whether it is time for Indonesia to start ratifying the CISG. The conclusion from the issue mentioned shows that it is the appropriate time for Indonesia to begin ratification of CISG into law of international trade contracts in Indonesia.
