Abstract

Hak Cipta adalah salah satu bagian dari Hak Kekayaan Intelektual yang salah satu objek yang dilindungi berupa karya sinematografi. Film adalah salah satu objek hak cipta yang dilindungi yang terkatagori dalam sinematografi. Pelanggaran hak cipta menimbulkan dampak yang besar bagi pencipta atau pemegang lisensi. Perkembangan teknologi yang memicu terbentuknya pelanggaran baru seperti penayangan film di channel youtube. Youtube menjadi salah satu perantara terjadinya pelangaran hak cipta pada penayangan film, oleh sebab itu penulis melakukan penelitian berjudul Perlindungan Hukum Atas Film Di Channel Youtube Tanpa Izin Oleh Pemegang Lisensi Hak Cipta Atas Film Ditinjau Dari Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Penelitian ini memiliki tujuan untuk mengetahui upaya hukum yang dapat dilakukan oleh pemegang hak cipta atas filmnya yang telah di putar tanpa izin serta kebijakaan youtube dalam menangani pelanggaran hak cipta atas penayangan Film tanpa Izin Penelitian yang digunakan penulis penelitian normatif dengan mengunakan jenis data sekunder yang berupa Peraturan PerUndangan-Undangan, Jurnal, Artikel hukum, sumber internet beserta kamus hukum dan kamus KBBI. Penelitian ini mengunakan teknik pengumpulan data secara studi pustaka dengan metode kualitatif. Upaya hukum yang dapat dilakukan oleh pencipta dan pemegang lisensi telah berupa Altenatif penyelesaian sengketa, Arbitrase maupun pengadilan. Pemegang lisensi berhak memperoleh ganti kerugian atas hak ekonomi dan dapat menuntut secara pidana serta dapat melakukan penutupan konten sesuai dengan kebijakan youtube. Youtube memiliki kebijakan berupa melakukan pemblokiran terhadap channel youtube dan memberikan sanksi bagi yang melakukan pelanggaran hak cipta. ********************************************************************** Copyright is one part of Intellectual Property Rights in which one of the protected objects is a cinematographic work. Film is one of the protected copyright objects categorized in cinematography. Copyright violations that have a major impact on the creator or licensee. The development of technology that develops is developing like a new screening of films on the YouTube channel. Youtube is one of those who oppose copyright infringement on screenings, therefore the author conducted a study entitled Legal Protection of Films on Youtube Channels Without Permission by the Copyright Holder of the Film in Terms of Law No. 28 of 2014 Concerning Copyrights. This research has the aim to learn about the law that can be done by the copyright holder for his films that have been played without permission with YouTube youtube in the completion of copyright on the screening of films without permission The research is used by normative research writers by using secondary data types in the form of Regulatory Regulations, Journals, Legal articles, internet sources along with legal dictionaries and KBBI dictionaries. This study uses the technique of collecting data in a literature study using qualitative methods. Legal remedies that can be done by the creator and license holder have been in the form of alternatives for dispute resolution, arbitration and court. The license holder is entitled to obtain compensation for economic rights and can prosecute criminally and can conduct content closure in accordance with YouTube policy. Youtube has a policy of blocking Youtube channels and sanctions for those who commit copyright infringement.
