Abstract

Teknologi berkembang dengan cepat beberapa tahun belakang seiring dengan Revolusi Industri 4.0. Banyak teknologi berbasis machine learning yang bermunculan, seperti Artificial Intelligence (Kecerdasan Buatan), Robot, Internet of Things, Big Data, dan masih banyak lagi. Teknologi-teknologi ini digunakan oleh banyak individu dan perusahaan besar untuk melakukan pekerjaan tertentu untuknya. Salah satunya adalah artificial intelligence yang kini banyak digunakan oleh manusia dalam kehidupan sehari-harinya tanpa disadari. Artificial Intelligence yang dimiliki oleh Google menghasilkan gambar klasik serupa dengan gaya lukisan oleh pelukis Rembrandt. Sony Inc. juga menggunakan artificial intelligence untuk menghasilkan lagu untuk digunakan oleh perusahaan yang bersangkutan, dengan atau tanpa lirik. Karya-karya ini, dalam proses penciptaannya, tidak melibatkan kreatifitas manusia sama sekali. Partisipasi manusia hanya sebatas memerintahkan program artificial intelligence untuk melakukan perintahnya. Karya yang diciptakan oleh artificial intelligence ini adalah karya yang memenuhi syarat untuk mendapat perlindungan hak cipta. Namun yang menjadi perdebatan adalah siapa yang berhak untuk memiliki hak cipta tersebut, karena artificial intelligence tidak diakui sebagai subjek hukum di sebagian besar negara di dunia. Penelitian ini bersifat normatif dengan melakukan perbandingan hukum antara Indonesia, Inggris, dan World Intellectual Property Organisation (WIPO) terkait isu ini. Penelitian ini bertujuan untuk memberi wawasan mengenai perlindungan hukum hak cipta terhadap karya yang diciptakan oleh artificial intelligence (kecerdasan buatan). Data dalam penelitian ini dikumpulkan secara kualitatif dan dianalisis dengan studi kepustakaan. ********************************************************************** Technology has vastly grown these past years following the Industry Revolution 4.0. There are many machine-learning based technologies growing, for instance Artificial Intelligence, Robots, Internet of Things, Big Data, and many more. These technologies are used by many individuals and major companies to do certain works for them. One of which is the artificial intelligence that is vastly used by people in their daily lives unconsciously. Artificial Intelligence that is owned by Google generated classical drawing with similar style as the painter Rembrandt. Sony Inc. also uses artificial intelligence to produce songs to be used by the company, with or without lyrics. These works in the process of its making does not involve human creativity at all. Human participation is merely ordering the artificial intelligence program to do its sequence. However, it is later become a debate topic on who is eligible to receive the copyright status, since artificial intelligence is not admitted as a legal subject in most states globally. This normative research is done with law comparison between Indonesia, the United Kingdom, and World Intellectual Property Organization (WIPO) specifically regarding this issue. This research purpose is to give insights regarding protection provided by copyright law towards works constructed by artificial intelligence. Data in this research is collected with qualitative method and analyzed with library research method.
