Abstract

Tindakan kekerasan kepada perempuan dan anak sering terjadi mengingat kondisi perempuan dan anak memiliki kemampuan yang lemah untuk membela diri. Dampak dari kekerasan tersebut tidak hanya mengakibatkan secara fisik namun juga secara psikis ataupun non-fisik. Disini peran dari hukum untuk tetap menjaga dan menindak lanjuti permasalahan tentang perlindungan hukum kepada para pelaku dan juga melindungi para korban. Namun, pada kenyataan masih belum dapat dilakukan dengan baik terutama terkait dengan perlindungan hukum kepada para korban tindakan kekerasan yaitu perempuan dan anak. Dalam penelitian ini penulis menggunakan penelitian Hukum Empiris. Dimana penelitian ini lebih mengarahkan kepada meneliti bagaimana penerapan hukum tentang perlindungan hukum terhadap para korban tindak pidana kekerasan yaitu perempuan dan anak di Kota Batam. Perlindungan kepada perempuan dan anak yang mana sebagai korban dari tindak pidana kekerasan telah dijalankan sebagaiamana tertuang pasal 58 Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Hal ini dibuktikan dengan adanya lembaga-lembaga khusus yang mengatasi permasalah dari korban tindak pidana. Namun, penerapan perlindungan hukum masih terdapat juga pelanggaran dalam proses pelaksanaan perlindungan hukumnya. Maka dari itu diperlukan suatu aturan-aturan yang khusus menangani hal tersebut dan dibutuhkan tenaga-tenaga yang ahli yang tidak hanya mengerti tindak pidana tetapi mengerti kondisi fisik maupun non fisik dari para korban agar perlindungan hukum dapat berjalan dengan baik, lancar dan efektif. ********************************************************************** Acts of violence against women and children often occur given the conditions of women and children have a weak ability to defend themselves. Here the role of the law is to maintain and follow up on issues concerning legal protection for the perpetrators and also protect the victims. However, in reality it still cannot be done properly, especially related to legal protection for victims of violence, that is women and children. In this study the authors used Empirical research. Where this research is more directed to examine how the application of the law on legal protection for victims of violent crime, that is women and children in the city of Batam Protection of women and children who are victims of violent crime has been carried out as stipulated in article 58 of Law Number 39 of 1999 concerning Human Rights. This is evidenced by the existence of special institutions that deal with the problems of victims of criminal acts. However, the application of legal protection is still a violation in the process of application legal protection. Therefore, special rules are needed to deal with this and experts are needed who not only understand criminal acts but understand the physical and non-physical conditions of the victims so that legal protection can run well, smoothly and effectively
