Abstract

Setiap anak di Indonesia pada dasarnya memiliki hak asasi, salah satunya yaitu dalam menjalani peninjauan pendidikan, sebagaimana terkandung dalam Undang-Undang Dasar 1945 Pasal 31 ayat (1). Dengan hal ini maka Kefektifan Hukum dan Hukum Perlindungan Anak dapat menjadi salah satu faktor terpenting dalam pemenuhan hak pendidikan bagi anak jalanan. Tujuan utama penulis dalam mengangkat penelitian skripsi tersebut yaitu untuk mengetahui hak anak yang dimiliki oleh anak jalanan dan penerapannya di Kota Batam. Penulis menggunakan metode penelitian berupa yuridis empiris. Data yang digunakan yaitu data primer sebagai pendukung dalam penelitian dan data sekunder. Pengumpulan data dilakukan dengan wawancara dan studi pustaka (library research). Setelah semua hasil yang telah terkumpul maka akan disusun dan dianalisa dengan metode kualitatif, yang maksudnya merangkai data yang telah diperoleh dan disusun secara sistematis. Selanjutnya ditarik kesimpulan dari hasil penelitian kemudian diuraikan secara deskriptif. Berdasarkan hasil penelitian ini, maka penulis dapat memberikan kesimpulan bahwa adanya suatu hubungan yang tidak sinkron antara undang-undang dasar 1945 dengan undang-undang Nomor 20 tahun 2003 dan undang-undang Nomor 35 tahun 2014 sebagai peraturan yang mengatur tentang hak anak dalam memperoleh pendidikan. Apabila ditinjau dari perspektif keefektifan hukum dan hukum perlindungan anak telah menunjukkan bahwa pemenuhan hak pendidikan anak jalanan di Kota Batam masih belum terpenuhi secara maksimal. ********************************************************************** Every Childs in Indonesia basically has human rights, one of which is in undergoing an education review, as contained in the 1945 Constitution Article 31 paragraph (1). With this, the effectiveness of the Law and Child Protection Law can be one of the most important factors in fulfilling the rights to education for the street childrens. The main purpose of the author in raising the thesis research is to find out the rights of children owned by street childrens and their application in the City of Batam The author uses a research method in the form of empirical juridical. The data used are primary data as a support in research and secondary data. Data collection is done by interviews and library research. After all the results have been collected, it will be compiled and analyzed by qualitative methods, which means compiling the data that has been obtained and arranged systematically. Furthermore, conclusions drawn from the results of the study are then described descriptively. Based on the results of this study, the author can conclude that there is an asynchronous relationship between the 1945 Constitution and Law Number 20 of 2003 and Law Number 35 of 2014 as regulations governing the rights of childrens in obtaining education. When viewed from the perspective of the effectiveness of the Law and Child Protection Law has shown that the fulfillment of the rights of street children’s education in the city of Batam is still not maximally fulfilled.
