Abstract

Anak merupakan sosok penerus generasi bangsa, oleh karena itu anak membutuhkan perlindungan khusus untuk melindungi setiap hak-hak anak agar mendapatkan perlindungan dari kekerasan dan diskriminasi. Penelitian ilmiah yang Peneliti lakukan bertujuan untuk menganalisa bagaimana bentuk pertanggungjawaban pidana terhadap pelaku tindak pidana eksploitasi ekonomi terhadap anak serta pemenuhan hak anak yang di eksploitasi ekonominya menurut Undang- Undang Nomor 35 Tahun 2014 Tentang Perubahan Atas Undang- Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak. Metode penelitian yang peneliti gunakan yaitu jenis penelitian hukum secara normatif, sebagaimana peneliti menggunakan data sekunder yang diperoleh dari bahan hukum kepustakaan dengan cara mengkaji aturan perundang-undangan, buku-buku, maupun literatur yang berkaitan dengan topik penelitian. Hasil penelitian yang telah Peneliti lakukan dapat disimpulkan bahwa untuk membuktikan pelaku tindak pidana eksploitasi ekonomi terhadap anak dapat dimintai pertanggungjawaban pidana apabila adanya suatu perbuatan tindak pidana, adanya kesalahan, adanya pembuat yang bertanggung jawab, tidak ada alasan pemaaf. Kemudian dalam hal pelaksanaan pemenuhan hak-hak anak sebagai korban eksploitasi ekonomi dapat disimpulkan belum seluruhnya terpenuhi sebagaimana yang diatur dalam Undang- Undang Nomor 35 Tahun 2014 Tentang Perubahan Atas Undang-undang nomor 23 Tahun 2002 Tentang Perlindungan Anak. ********************************************************************** Children are the successor figures of the nation's generation, therefore children need special protection to protect each child's rights in order to get protection from violence and discrimination. Scientific research conducted by researchers aims to analyze how the form of criminal liability towards perpetrators of economic exploitation crimes against children as well as fulfillment of the rights of children who are exploited economically according to Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection. The research method that researchers use is a type of normative legal research, as researchers use secondary data obtained from library legal materials by studying the rules of law, books, and literature relating to the research topic. Research results that have been done by researchers can be concluded that to prove the perpetrators of economic exploitation crimes against children can be held liable for criminal acts if there is a criminal act, an error, the responsible maker, there is no excuse for forgiveness. Then in terms of implementing the fulfillment of children's rights as victims of economic exploitation it can be concluded that not all have been fulfilled as regulated in Law Number 35 Year 2014 concerning Amendments to Law number 23 Year 2002 concerning Child Protection.
