Abstract

Keberhasilan dalam lingkungan penanaman modal untuk menarik penanam modal menanamkan modal, baik penanaman modal dalam negeri maupun luar negeri memerlukan adanya tata pemerintahan yang baik dan kepastian hukum dalam perizinan berusaha. Pemerintah Negara Republik Indonesia dalam rangka menciptakan dunia perizinan berusaha yang lebih kondusif dan efisien telah meluncurkan sistem Online Single Submission (untuk selanjutnya disebut sebagai OSS) sesuai dengan Peraturan Pemerintah Nomor 24 Tahun 2018 tentang Pelayanan Perizinan Berusaha Terintegrasi Secara Elektronik. Melalui skripsi ini, Peneliti bertujuan untuk menganalisa dan menguraikan implementasi, permasalahan, dan kendala yang terjadi dalam proses pengajuan perizinan berusaha bagi Perseroan Terbatas melalui sistem OSS di Kota Batam. Peneliti dalam melakukan penelitian ini menggunakan jenis penelitian hukum empiris, yaitu penelitian lapangan, yang mana merupakan sebuah metode penelitian hukum yang berupaya untuk melihat hukum dalam artian yang nyata atau dapat dikatakan melihat, meneliti bagaimana bekerjanya hukum di masyarakat. Peneliti melakukan observasi di lapangan dan mewawancarai respoden/user maupun narasumber guna dijadikan sebagai data primer. Data sekunder yang merupakan bahan yang diperoleh dari studi kepustakaan terbagi atas bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian yang didapatkan Peneliti adalah sistem OSS diluncurkan sesungguhnya memberikan perubahan paradigma atau kerangka berpikir masyarakat, yang selama ini penanam modal harus menyiapkan terlebih dahulu persyaratan-persyaratan baru bisa memproses izin berusaha. Sistem tersebut akan efektif dijalankan apabila telah terintegrasi dengan pelbagai perizinan berusaha antar Kementerian dan departemen, terutama kendala mengenai izin-izin yang tidak secara langsung berlaku efektif. ********************************************************************** Successing in the investment environment to attract investors to invest capital, both domestic and foreign investment requires good governance and legal certainty in business licensing. The Government of the Republic of Indonesia in order to create a more conducive and efficient business licensing system has launched the Online Single Submission system (hereinafter referred to as OSS) in accordance with Government Regulation Number 24 of 2018 concerning Business Licensing Services Integrated Electronic. Through this thesis, the researcher aims to analyze and describe the implementation, problems, and obstacles that occur in the process of applying for business lincenses submission process for Limited Liability Companies through the OSS system in Batam City. Researchers in conducting this research use empirical legal research, namely field research, which is a legal research method that seeks to see the law in terms that are real or can be seen to see, examining how the law works in society. Researchers conduct observations in the field and interview respondents / users and resource persons to serve as primary data. Secondary data which is the material obtained from the literature study is divided into primary legal materials, secondary legal materials, and tertiary legal materials. The results of the research obtained by the researcher are that the OSS system was launched which actually provides a paradigm shift or community frame of mind, which so far investors must prepare in advance the new requirements that can process business permits. The system will be effectively implemented if it has been integrated with various business licenses between Ministries and departments, especially the constraints regarding permits that are not directly effective.
