Abstract
Penelitian ini dilakukan oleh Penulis berawal dari maraknya kasus yang dicurigai sebagai aksi pencucian uang dan penipuan yang terjadi di antara bank-bank di Indonesia salah satu nya di BCA khususnya BCA KCU Kota Batam. Penelitian ini bertujuan untuk menjelaskan prosedur penerapan prinsip uji tuntas nasabah dan cara penanganan kasus transaksi mencurigakan yang muncul yang dilakukan oleh nasabah. Peneliti menggunakan metodelogi penelitian hokum empiris di mana penelitian hukum ini penelitian yang dilakukan dengan cara mengobservasi secara nyata di mana cara kerja penelitian ini adalah meneliti bagaimana hukum bekerja di dalam kehidupan masyarakat dengan penelitian pustaka menggunakan cara observasi dan wawancara . Setelah semua data terkumpul, maka data kemudian di saring dan di analisis, analisis yang digunakan secara kualitatif dengan mengelompokkan aspek-aspek yang diteliti. Selanjutnya diambil kesimpulan yang berkaitan dengan penelitian ini dan diuraikan secara deskriptif. Berdasarkan penelitian ini, maka diperoleh hasil penelitian dasar otoritas jasa keuangan mewajibkan pelaksanaan Know Your Customer di bank, serta Customer Due Diligence yang diterapkan di bank, tidak hanya digunakan sebagai langkah pencegahan, melainkan untuk penaganan tindak lanjut yang mana prinsip ini tetap digunakan untuk mengatasi transaksi – transaksi mencurigakan yang timbul di kemudian hari dan dapat mengetahui akibat hukum yang muncul apabila tidak dilakukannya Customer Due Diligence pada transaksi perbankan. ********************************************************************** This research was carried out by the author starting from the rise of cases suspected of being money laundering and fraud that occurred among banks in Indonesia, one of them at BCA, specifically the BCA KCU, Batam. This study aims to explain the procedure for applying the principle of customer due diligence and how to handle cases of suspicious transactions that occur that are carried out by customers. Researchers use the empirical legal methodology of research where this legal research research is carried out by observing in a real way where the workings of this research are examining how the law works in people's lives with library research using observations and interviews. After all the data is collected, the data is then filtered and analyzed, the analysis used qualitatively by grouping the aspects studied. Then conclusions related to this study were taken and described descriptively. Based on this research, the results of the study show that the Customer Due Diligence applied in banks is not only used as a preventative measure, but also for the management of follow-up actions which this principle is still used to deal with suspicious transactions that arise later.
