Abstract
Anak-anak rentan terhadap segala macam bahaya. Dengan perkembangan internet, jenis bahaya baru muncul, seperti pornografi anak. Ini adalah masalah besar di Indonesia saat ini. Data menunjukkan bahwa sejumlah besar orang mengakses pornografi anak setiap hari di Indonesia. Ini perlu dihentikan sekarang juga karena membahayakan masa depan anak-anak. Dengan demikian, penelitian ini dibuat untuk membandingkan perlindungan hukum yang disediakan oleh Optional Protocol of United Nations Convention on the Rights of the Child dan Hukum Indonesia dan juga apakah Hukum Indonesia telah memberikan perlindungan optimal yang diperlukan oleh anak-anak dalam hal pornografi anak. Penulis akan menggunakan metode normatif dalam penelitian ini, di mana data literatur akan dianalisis dan digunakan. Jenis data yang akan digunakan adalah data sekunder dimana merupakan data yang dikumpulkan dan diproduksi oleh orang lain. Kemudian, metode yang digunakan untuk analisis data adalah metode kualitatif di mana penulis memberikan laporan dengan penjelasan deskriptif. Setelah menggunakan metode penelitian tersebut, penulis dapat memperoleh dan menganalisis data. Penulis dapat membandingkan perlindungan hukum yang diberikan beserta celah yang menyebabkan terjadinya kasus-kasus pornografi anak di Indonesia dimana penulis megajukan beberapa tindakan balasan dengan harapan meminimalkan kasus-kasus tersebut agar tidak terjadi. ********************************************************************** Children are vulnerable towards all kinds of danger. With the development of the internet, new kind of danger emerges, like child pornography. This is one of the major problems in Indonesia right now. Data shows that a large number of people access child pornography contents daily in Indonesia. This needs to be stopped now as it dangers the future of the children. As such, this research is made to compare the legal protections that were provided by the Optional Protocol of United Nations Convention on the Rights of the Child and the Indonesian Law, and whether the Indonesian Law has fulfilled the mandates as well as providing the optimal protection needed by the children in regards of child pornography. Author will be using the normative method in this research, where data literatures will be analyzed and used. The type of data used will be secondary data which is the kind of data that has been collected and produced by others. Then, the method used for the data analysis will be the qualitative method in which the author provides a report with descriptive explanation. After using those research methods, author was able to obtain and analyzes the data. Author was able to compare the legal protection given as well as the loophole causing cases of child pornography occurring in Indonesia where the author suggested a few counter measurements in hopes of minimizing the cases from happening.
