Abstract

Penulis melakukan penelitian yang berjudul Analisis Yuridis Penjaminan Hak Atas Tanah Yang Sudah Berakhir Sedangkan Perjanjian Kredit Belum Berkahir Di Bank Perkreditan Rakyat Di Kota Batam, penelitan ini Pihak kreditur memberikan kredit kepada debitur dengan jangka waktu kredit lebih lama dari jangka waktu jaminan hak atas tanah tersebut sehingga kredit yang diberikan oleh pihak kreditur mengandung suatu resiko, sehingga apabila berakhir nya jangka waktu hak atas tanah tersebut berakhir sebelum perjanjian kredit belum berakhir maka akan mempunyai akibat hukum terhadap eksitensi dari hak tanggungan tersebut, dalam penelitian ini dibahas permasalahan yang mengenai perlindungan hukum terhadap kreditur dalam hak atas tanah yang jangka waktunya telah berakhir sedangkan perjanjian kredit masih belum berakhir serta upaya yang dapat dilakukan oleh pihak kreditur terhadap perjanjian kredit yang belum berakhir sedangkan jaminan hak atas tanah tersebut telah berakhir. Tujuan dalam melakukan penelitian ini adalah penulis dapat mengetahui perlindungan dan upaya diterima atau dilakukan oleh kreditur tersebut. Metode penelitian yang dilakukan oleh penulis adalah yuridis empiris. Penulis melakukan teknik pengumpulan data dengan cara wawancara dan observasi. Setelah teknik pengumpulan data tersebut telah dilakukan, penulis segera melakukan analisis dalam data tersebut dalam menyelesaikan permasalahan yang sesuai dengan rumusan masalah penulis. Hasil penelitian terhadap permasalahan yaitu upaya yang dapat dilakukan oleh kreditur yaitu dengan mengunakan cara pembaharuan hak atas tanah dan pengikatan jaminan fidusia, dalam melakukan pengikatan jaminan fidusia pada saat masa berakhirnya jangka waktu hak atas tanah tersebut. perlindungan hukum atas jaminan hak atas tanah yang sudah berakhirnya jangka waktu tersebut, tetap memiliki perlindungan hukum kepada kreditur. ********************************************************************** The authors conducted a study entitled analysis of the Juridical Guarantee Land Rights Which has ended while the Credit Agreement haven`t ended in the Bank at Batam city, in this research, creditor is giving credit to debtor with term of credit longer than the term of the land rights, therefore credit given by the debtor contains a risk, If the term of land rights ends before the credit agreement not over yet will have legal consequences against the existence of the mortgage right, in this research discussed the problems concerning legal protection of creditors in land rights that duration has expired while the credit agreement still not ended, and the efforts that can be applied by the creditor against the credit agreement not over while the land rights of guarantee has expired. The purpose in doing this research is to know the protection and efforts are received or performed by the creditor. The method of research conducted by the author is empirical juridical. The author did data collection techniques by means of an interview and observation. After the data gathering have been collected, the author undertook the analysis in such data in solving problem formulation that corresponds to the author. The results of research on the issue, namely the effort that can be performed by the lender that is by using the way of renewal of land rights and fiduciary guarantee of the binding, the binding fiduciary guarantee in performing at the time of the expiration of the time period the land rights. legal protection to security rights over the land which is already the end of that period, still have the legal protection to the lender.
