Abstract

The Indonesian state has adopted Law No. 39 of 2004 on the Placement and Protection of Indonesian Workers Abroad and Law No.21 of 2007 on the Elimination of Criminal Acts on Trafficking in Persons. The issuance of these laws aims to regulate the right of migrant workers on the protection and placement. In order to implement Law No.21 of 2007 in the Riau Islands Province, the Riau Island Government issued Law No. 12 of 2007 on the Elimination of Trafficking of Women and Children (Trafficking). This research aims to analyze how the national laws, namely Law No.39 of 2004 and Law No.21 of 2007 are implemented in Batam which is part of the Riau Islands Province. This research uses a normative legal research. The type of normative legal research adopted by this research is legal synchronization. In this connection, the research attempts to ascertain whether Law No.39 of 2004 and Law No.21 of 2007 are fully implemented or whether the Government of Riau Islands Province should issue a special regional to comply with the two laws. The research finds that the application of Law No.21 of 2007 has been well adopted in Riau Islands Province through the implementation of Law No.12 of 2007. Yet, this Law particularly regulates the protection of migrant workers who become human trafficking victims. Not all migrant workers are victims of human trafficking, therefore, it is suggested by this research that the government of Riau Islands Province also issues a regional law specifically for the protection of migrant workers who are not victims of human trafficking.
