Abstract

Penempatan karyawan pada perusahaan merupakan salah satu penentu keberhasilan perusahaan dimana penempatan karyawan pada posisi yang tepat akan menyebabkan tingginya potensi karyawan dalam hal produktifitas yang diiharapkan demi berkembangnya perusahaan itu sendiri. Mutasi karyawan merupakan salah satu aspek penting dalam pengelolaan sumberdaya manusia. Secara umum dalam pelaksanaan mutasi karyawan sering berpotensi menimbulkan konflik karena penolakan atas pelaksanaan mutasi dan berakhir pada pemutusan hubungan kerja. Tujuan penelitian ini adalah untuk menguji efektifitas hukum dalam pelaksanaan mutasi karyawan dimana dalam penelitian ini diuraikan dan dikupas apa saja yang menjadi landasan pelaksanaan mutasi, menguji efektifitas dalam pelaksanaan mutasi karyawan, menganalisa hambatan serta memberikan jalan keluar bagi pelaksanaan mutasi karyawan. Pengumpulan data dilakukan dengan teknik wawancara tidak terstruktur dengan sampel pekerja dan pihak manajerial perusahaan pada PT Bank Central Asia,Tbk di kota Batam. Pemilihan sampel dilakukan dengan metode purposive sampling dengan metode yuridis sosiologis. Hasil penelitian menunjukkan bahwa perusahaan belum efektif dalam pelaksanaan mutasi karyawan. Secara hukum perusahaan telah melaksanakan amanah perundang-undang yang berlaku khususnya tentang mutasi karyawan dimana telah dituangkan perusahaan bersama-sama dengan serikat pekerja dalam perjanjian kerja bersama. Dalam pelaksanaannya potensi konflik masih terjadi akibat belum efektifnya kinerja serikat kerja cabang sebagai fungsi pengawasanserta adanya sudut pandangan yang berbeda antara karyawan dengan perusahaan tentang prinsip dan asas pada pelaksanaan mutasi. ********************************************************************** Employee placement in the company is one of the determinants of the success of the company where the placement of employees in the right position will cause high potential of employees in terms of productivity that is expected for the development of the company itself. Employee mutation is an important aspect in human resource management. In general, the implementation of employee mutations often has the potential to cause conflict due to rejection of the implementation of mutations and ending in termination of employment. The purpose of this study is to test the effectiveness of law in implementing employee mutations where in this study are described and discussed what is the basis of the implementation of mutations, test the effectiveness in implementing employee mutations, analyze obstacles and provide a way out for the implementation of employee mutations. Data collection is done by unstructured interview techniques with samples of workers and company managerial parties at PT Bank Central Asia, Tbk in Batam city. Sample selection is done by purposive sampling method with sociological juridical method. The results of the study show that the company has not been effective in implementing employee mutations. By law the company has carried out the mandate of the applicable legislation especially regarding employee mutations which the company has set out together with trade unions in collective labor agreements. In its implementation the potential for conflict still occurs due to the ineffective performance of branch labor unions as a function of supervision as well as the existence of different points of view between employees and companies regarding principles and principles in implementing mutations.
